Blind Bay Resort to close amid rumour and controversy

Blind Bay Resort will close at the end of March.

When and in what format the resort reopens and is operated is yet to be determined by the owners of Strata KAS3359.

Due to ongoing sewage problems at the resort, on Jan. 30, the Ministry of Environment (MoE) issued a Pollution Abatement Order to owners of KAS3359 Strata Council and Daniel Baskill of Jaydan Ventures Inc. due to the release of municipal wastewater at the ground surface from a wastewater treatment system located on the land described as common property.

In a Feb. 19 email, a Ministry of Environment spokesperson noted that 鈥渨hile the resort's wastewater treatment system management was transferred to the Strata in May 2021, Jaydan Ventures has not yet applied to transfer or modify the Municipal Wastewater Regulation registration. This is why Jaydan Ventures is also named in the PAO, as well as any associated Administrative Monetary Penalties (AMPs) and inspection reports.

Ownership and operation of the septage utility has long been an issue between the developer and the strata, which, seeking to dissociate itself from Jaydan Ventures changed the name of the strata to KAS3359 Copper Landing.

On April 11, 2022, Jaydan sent MoE a letter authorizing the transfer of authority for the sewage disposal field and sewerage equipment to Strata KAS3359. The strata took over full control and responsibility of the sewerage for the site following their first meeting on May 19, 2021, as per the Strata Property Act, and Jaydan Ventures Inc. became a contributor towards costs associated with the management of the utility along with all other 85 KAS3359 strata owners.

But in an April 2023 email to the ministry Jaydan Ventures stated it would be taking immediate steps to remedy as per MoE requirements. 

"Jaydan Ventures wishes to assert that we do not intend to transfer ownership of our system to KAS3359 and will not permit them to register authorization to operate the system," reads the email.

In a Feb. 21, 2025 interview, Baskil said he had signed over the sewerage utility to the strata as per provincial requirements in 2021, along with a fully engineered offsite solution that was surveyed and had permits forthcoming to remedy the matter. 

But Colin Chalmers, President of KAS3359 Copper Landing Strata says Jaydan鈥檚 solution was to bypass the system and pump untreated effluent up to the Shuswap Lake Utilities, making the on-site system unnecessary. As well, Chalmers says MoE and MOTI received nothing regarding Jaydan鈥檚 proposed system.

"The reality is, it was never even an option," Chalmers says, pointing out MoE assessed Jaydan Ventures with administrative penalties of $58,900 for contravening the municipal wastewater regulation in the fall of 2024. "He claims he owns everything but he is making no effort to repair the current system."

Chalmers is quick to point out that effluent from Blind Bay resort has never applied for nor operated a lake outfall in which treated sewage is disposed of in the lake.

At a special general meeting on April 13, 2023, strata owners agreed to a special levy to fund repairs to the system, with Jaydan's share amounting to $315,000-plus. Chalmers says Jaydan has never paid his share, but all other 85 strata members contributed $11,267 each.

Meanwhile, the Supreme Court of Canada has issued an order that the commercial property formally known as Blind Bay Resort be sold in a foreclosure. Proceeds of a sale would first satisfy liens Strata KAS3359 Copper Landing has placed on Jaydan Ventures for unpaid levies and fees, with the remainder going to Jaydan鈥檚 lender, Interior Equities Corp.

Another KAS 3359 Copper Landing special general meeting will be held on March 27 at which time strata members will be asked to approve the acquisition.

鈥淥nce we acquire the property the proceeds will top up sewer repair,鈥 Chalmers says, noting work on a new off-site utility has already begun, with engineered design work underway and material already ordered. 鈥淲e are hoping the transaction will conclude in April and construction will begin immediately.鈥

Once the land transaction is complete, KAS3359 Copper Landing will have ownership and control of the land on which the resort sits, including 85 individual lots, the campground and the marina.
